These terms of service ("Terms") are an agreement between you and Balliram ("we", "us") about your use of the FlingShot mobile game ("the app", "the game"). By downloading, installing or playing FlingShot you agree to these Terms. If you do not agree, please do not use the game.
1. Summary
- FlingShot is free to play and supported by ads.
- Coins, power-ups and cannon skins are game items only. They have no real-world value and cannot be bought, sold or exchanged for money.
- Your progress is saved only on your device. If you uninstall the game or clear its data, it cannot be recovered.
- Play fair and enjoy the game. We provide it "as is", without guarantees.
2. Who can use the game
You may use FlingShot if you can form a binding agreement with us, or if a parent or legal guardian has agreed to these Terms for you. If you are under the age of majority where you live, please review these Terms with a parent or guardian.
3. License to use the game
We give you a personal, limited, non-exclusive, non-transferable and revocable license to install and play FlingShot on devices you own or control, for your own non-commercial entertainment. You may not:
- copy, modify, distribute, sell, rent or lease the game or any part of it
- reverse engineer, decompile or try to extract the source code, except where the law expressly allows it
- use cheats, bots, modified versions of the app or other tools to change how the game works
- interfere with or block the ads, or generate fake ad views or clicks
- use the game in any unlawful way or for any unlawful purpose
4. Game items and progress
The game lets you earn coins and unlock power-ups and cannon skins by playing, by collecting daily rewards and by choosing to watch rewarded ads. These items:
- are part of the game only and have no monetary value
- cannot be transferred, sold or redeemed for money or anything else of value
- are stored only on your device, and can be lost if you uninstall the app, clear its data or change devices
We may change, rebalance or remove game items, levels, rewards and features at any time to improve the game.
FlingShot currently has no in-app purchases. If we add purchases in the future, these Terms will be updated, and purchases will be handled by Google Play or the Apple App Store under their own terms.
5. Advertising
FlingShot shows ads provided by Google AdMob. Rewarded ads are always optional. Ads are provided by third parties, and we are not responsible for the content of ads or for any products, services or websites they promote. How ads use data is explained in the FlingShot Privacy Policy.
6. Privacy
Your privacy matters to us. The FlingShot Privacy Policy explains what information is stored and how it is handled. By using the game you also agree to the Privacy Policy.
7. Intellectual property
The game, including its code, graphics, 3D models, levels, sounds, name and logo, belongs to Balliram or its licensors and is protected by copyright and other laws. These Terms do not give you any ownership rights. Other trademarks that may appear, such as Google Play and the App Store, belong to their owners.
8. App stores
You downloaded FlingShot from Google Play or the Apple App Store. Your use of the game is also subject to that store's terms. If you downloaded the game from the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them, but Apple has no responsibility for the game, its maintenance or support, or any claims relating to it.
9. Updates and availability
We may release updates that fix problems, change features or add content, and some updates may be required to keep playing. We may also change, suspend or stop the game, in whole or in part, at any time. We are not required to keep the game available.
10. Disclaimer
FlingShot is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the game will be uninterrupted, error-free, or compatible with every device, or that saved progress will never be lost.
11. Limitation of liability
To the fullest extent permitted by law, Balliram will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, progress or game items, arising from your use of or inability to use the game. As the game is free, our total liability for any claim relating to the game is limited to the amount you paid us, which is zero. Some countries do not allow these limits, so they may not apply to you, and nothing in these Terms limits rights you have under consumer protection law that cannot be waived.
12. Termination
These Terms apply until ended by you or us. You can end them at any time by uninstalling the game. We may end your license if you break these Terms. When the Terms end, you must stop using the game and delete it.
13. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top will change, and continuing to use the game after an update means you accept the new Terms.
14. Governing law
These Terms are governed by the laws of India, without regard to its conflict of law rules. Any dispute will be handled by the courts of India, unless the consumer protection laws of your country give you the right to bring a claim where you live.
